Information on the processing of personal data by Aquaform Incorporated sp. z o.o. regarding the organization and handling of a webinar and online training

Pursuant to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC ("GDPR"), we inform you, as persons using or able to use the services of Aquaform Incorporated sp. z o.o., about the manner and purpose for which we process your personal data ("Data"), as well as about your rights in the protection of this Data.

  2. Legal grounds for Data processing:

    We process your data in accordance with the provisions of the GDPR and Polish data protection regulations:

    1. in connection with your consent to participate in a webinar/online training organized by AQForm, the Data provided by you for the purpose of participating in the training (e.g. IP address of the device, which allows remote access to the training, nickname), will be processed by AQForm based on the premise referred to in Art. 6 (1)(a) of the GDPR, i.e. based on your consent. Such consent may be withdrawn by you at any time, and the withdrawal does not affect the lawfulness of data processing until the consent is withdrawn,
    2. based on the legitimate interests of AQForm (Art. 6 (1) (f) of the GDPR), consisting in:

      • organization and operation of webinars and online trainings in which you participate, including keeping records,
      • if applicable, conducting litigation, as well as proceedings before public authorities and other proceedings, including for the purpose of pursuing and defending against claims,
      • taking actions to ensure the ICT environment security,
      • taking actions to market products and services provided by AQForm.
  3. Data retention period

    Your Data will be stored for the period necessary to implement the above-mentioned purposes, in particular:

    • establishing the existence, pursuit or defense of claims, including defense against claims that are time-barred - for a period of time resulting from the running of general limitation periods,
    • in the case of processing your Data on the basis of consent, we will cease to process your Data for the purpose specified in the consent, immediately after you request the deletion of this data or withdrawal of consent.
  4. Data recipients

    Your Data may be made available to the following categories of entities for the purposes indicated in point 2 above:

    • to public authorities, as well as entities performing public tasks or acting on behalf of public authorities, to the extent and for purposes that result from the provisions of applicable law;
    • entities supporting AQForm in its business processes, including entities processing Data for AQForm (the so-called data processors), e.g. Internet service providers,
    • institutions cooperating with AQForm in terms of the offer of products and services that you use through AQForm.
  5. Transferring Data outside the European Economic Area

    Your Data provided for the purpose of participating in the online training/webinar may also be transferred to some subcontractors or IT system suppliers (e.g. Facebook, Inc. based in the USA), i.e. recipients located in countries outside the European Economic Area, for which the European Commission has not established an adequate level of personal data protection. The transfer of personal data takes place on the basis of standard data protection clauses. Recipients based in countries outside the European Economic Area have implemented adequate or appropriate security for your personal data.

  6. Rights of the Data subject

    You have the right to:

    • access your personal Data,
    • request rectification of Data,
    • request deletion of Data,
    • request limitation of processing of Data;
    • object to Data processing,
    • request to stop processing the Data,
    • request to transfer the Data, in a structured and commonly used machine-readable format, to another data controller, which you can use, if technically possible (the law does not apply to Data that is confidential to AQForm),
    • withdraw consent to the processed Data at any time (in the event that your consent is the basis for the processing of Data by AQForm),
    • lodge a complaint to a supervisory body, i.e. The President of the Office for Personal Data Protection , if you believe that the processing of your Data by AQForm violates the provisions of the GDPR.

    In addition, you have the right to object to the processing of Data at any time for reasons related to your particular situation, if AQForm processes the Data in order to carry out its legitimate interests.

    If the Data is processed for direct marketing purposes, you have the right to object to the processing for direct marketing purposes at any time.

  7. Voluntary Data provision,

    To the extent that the processing of Data takes place in order to participate in the online training/webinar, the provision of Data by you is voluntary, but necessary to participate in the online training/webinar.

  2. Legal grounds for Data processing

    Your Data will be processed for direct marketing of AQForm products and services - the legal basis for Data processing is consent (Art. 6 (1)(a) of the GDPR) and the implementation of the legitimate interests of AQForm, for which AQForm considers the possibility of pursuing and defending claims, ensuring the security of the ICT environment, possible handling of your objection or declaration of withdrawal of consent, application of internal processes of compliance with the law (Art. 6 (1)(f) of the GDPR)

  3. Data recipients

    Your personal data may be made available to entities processing Data at the request of AQForm (including IT service providers, marketing agencies) - where such entities process the Data on the basis of a contract with AQForm and only at the request of AQForm.

  4. Data retention period

    To the extent that the basis for processing is your consent, the Data will be stored until you withdraw your consent. To the extent that the basis for processing is the legitimate interest of AQForm, your Data will be stored until the legitimate interests of AQForm underlying this processing have been fulfilled.

  5. Rights of the Data subject

    You have the right to:

    • access your personal Data,
    • request rectification of Data,
    • request deletion of Data,
    • request limitation of processing of Data;

    At your request, AQForm will provide a copy of the Data undergoing processing.

    To the extent that the basis for the processing of your Data is the premise of the legitimate interest of AQForm, you have the right to object to the processing of your Data. To the extent that the basis for processing your personal Data is your consent, you have the right to withdraw your consent.

    The withdrawal of the consent does not affect the legality of the data processing performed prior to the withdrawal of the consent.

    To the extent that your Data is processed in an automated manner in order to conclude and perform a contract or processed on the basis of consent - you have the right to transfer the Data, i.e. receive your Data from AQForm, in a structured, commonly used machine-readable format, which you can use, if technically possible. You can send this Data to another data controller.

    You also have the right to lodge a complaint with the supervisory body dealing with the protection of personal data, i.e. the President of the Office for Personal Data Protection (ul. Stawki 2, 00-193 Warsaw).

  6. Voluntary Data provision

    Providing Data for marketing purposes is voluntary, however, it may be necessary in order to obtain benefits from AQForm.
